Please read these Terms carefully. By using scrappytheappy.com, submitting any form, or using any Scrappy the Appy service™, you agree to these Terms. If you do not agree, do not use the service. These Terms are provided for information about how the service works; they are not legal advice to you. If you have questions about your legal rights, talk to your own attorney.
1. What Scrappy the Appy is (and is not)
Scrappy the Appy ("Scrappy," "we," "us") is only a free connection and referral platform. We connect people who have unwanted items, scrap, or junk ("Customers") with independent scrappers, haulers, and collectors ("Scrappers"). Customers and Scrappers are together called "Users."
Scrappy does not pick up, haul, buy, sell, store, recycle, or dispose of any items. We do not take part in any agreement, pickup, or payment between Users. Any arrangement is made solely between the Customer and the Scrapper.
2. Scrappers are independent third parties
Scrappers are independent third parties. They are not employees, agents, partners, representatives, or contractors of Scrappy the Appy. Each Scrapper is reviewed and approved by Scrappy the Appy™ before receiving leads, and Customers rate every pickup. However, Scrappy the Appy™ does not perform background checks, and does not license, insure, bond, train, supervise, or control Scrappers. Because Scrappers are independent, Scrappy does not guarantee their identity, conduct, qualifications, reliability, or work, and Customers should use normal judgment when arranging and completing any pickup. Scrappy also makes no guarantee about any item, pickup, price, payment, timing, or outcome.
3. No responsibility for what happens between Users
To the fullest extent allowed by law, Scrappy the Appy is not responsible for, and you release Scrappy from, any claims relating to:
- damage to property, homes, driveways, yards, vehicles, or belongings;
- personal injury, illness, or death;
- theft, loss, or items taken that should not have been;
- disputes, disagreements, or misconduct between Users;
- pricing, payments, non-payment, or what an item is worth;
- no-shows, late arrivals, cancellations, or incomplete pickups;
- the ownership, condition, or legality of any item, or how it is transported, recycled, or disposed of.
4. No warranties ("AS IS")
The website and service are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not promise that a match will be found, that the site will be error-free, or that any User will act as promised.
5. Limitation of liability
To the fullest extent permitted by law, Scrappy the Appy will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the service or any interaction between Users. In any case, Scrappy's total liability for any claim will not exceed the greater of the amount you paid Scrappy in the 12 months before the claim (currently $0) or $50.
6. You agree to indemnify Scrappy
You agree to defend, indemnify, and hold harmless Scrappy the Appy and anyone acting on its behalf from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney fees) arising out of your use of the service, your items, your pickup or hauling activities, your dealings with another User, your violation of these Terms, or your violation of any law or anyone's rights.
7. Your safety and your responsibilities
- Safety: You are responsible for your own safety. Use common sense, meet in safe conditions, and consider having another person present.
- Verify the other party: You are responsible for checking who you are dealing with, including identity, vehicle, licenses, or insurance if that matters to you.
- Own what you give away: Customers must only offer items they own or have the right to give away.
- Follow the law: Users must follow all applicable laws, including the scrap metal and recycling laws of the state where the pickup happens (for example, record-keeping and ID rules that apply to scrap sales), local ordinances, and transportation rules.
- Vehicles: Vehicles, trailers, and boats must have proper title or ownership documents transferred as required by law. Scrappy does not handle titles.
- Hazardous materials are not accepted through Scrappy unless they are handled fully legally by a qualified party. This includes refrigerant (such as in refrigerators, freezers, and air conditioners), propane and other gas tanks, batteries, fuel, oil, chemicals, asbestos, and similar materials.
8. Age requirement
You must be at least 18 years old to use Scrappy the Appy.
9. Contact consent and information sharing
By submitting a form, you agree that Scrappy the Appy and your matched party may contact you by text message, email, or phone call about your request, registration, pickup, and reviews. Message and data rates may apply. You can ask us to stop at any time by replying STOP to a text or emailing us. You also agree that the information you submit (such as your name, phone, email, address or general location, and item details) may be shared with the Customer or Scrapper you are matched with so the pickup can happen.
10. Reviews
We may ask Users to leave reviews after a pickup. Reviews must be honest, based on your own experience, and must not include threats, hate speech, personal information about others, or false statements. We may edit, decline to post, or remove reviews at our discretion, and we may use reviews (without your contact details) to improve and promote the service.
11. Removing users or content
We may refuse service, remove listings or content, or suspend or remove any User at any time, for any reason or no reason, including suspected unsafe, illegal, or dishonest behavior.
12. Fees and changes to these Terms
Scrappy the Appy is free right now, but it may not always be. We may add fees or paid features in the future and will post them before they apply. We may update these Terms at any time by posting the new version with a new "Last updated" date. Using the service after changes means you accept them.
13. Privacy
What we collect: information you give us in forms (name, phone, email, address or location, item details, photos, service area, vehicle info, and reviews), plus basic technical data our website host collects automatically (such as IP address and browser type).
How we use and share it: to match Customers and Scrappers, contact you about requests and reviews, run and improve the service, and keep it safe. We share your information with your matched party, with service providers that help us run the site (such as our web host and form provider), and when required by law. We do not sell your personal information. To ask us to update or delete your information, email scrap@scrappytheappy.com.
14. Governing law
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Michigan, and you consent to their jurisdiction.
15. General
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and Scrappy the Appy about the service.
